Per BOMA 2024, for enclosed patio area (above grade) that is associated with the building conference center (has a tenant allocation) if the conference center were to be allocated as a building amenity, can the patio area be allocated as BAA as well?

Hi Sopheap,
When you say the patio is "enclosed", is it not exposed to the elements at all?
Also, is the building conference center available for all tenants to use with no additional fees or do you charge additional fees for its use?

Hi David,
I realized I miss stated in my previous question. The Patio is unenclosed, above grade on the 1st level but there are built seating areas with fireplace that has a built covering. The conference center adjacent to this is allocated as tenant area and not building amenity as there is a usage fee.

Hi Sopheap,
Assuming that the patio is only accessible through the conference center with its usage fee, then it would be designated as an "Unenclosed Tenant Area", which is a subset of "Non-Allocated Tenant Area" under the BOMA 2014 Office Standard. If however, the patio is available for use by all of the occupants in the building without a usage fee then it should be designated as a Service Area (either Building Service Area or Inter-Building Service Area). The reason why it would be a Service Area rather than an Amenity Area is to prevent it from receiving any proportionate allocation of Floor Service Areas. This is stated in the standard under Special Conditions, Exterior Areas, page 52.

Thanks for the clarification, David. Much appreciated it. Just to confirm, if the unenclosed patio is both accessible from the conference center and the outside, does this change the Building Service allocation as mentioned?

If the patio is available to the general public then it would not be included at all. Otherwise, the Service Area allocation is correct.
