Garage Parking as part of Building Area

JB Ballard

Should the measurement of an attached Parking Garage be included in the calculation of the rentable square feet of a building for purposes of defining pass-though prorata shares? Specifically, the lease determines the tenant's prorata share as the rsf of the premises/the rsf of the building. In this case, "building" is not a defined term.

Parking Area is part of the Boundary Area of the Building, but it is a excluded from Rentable Area, except for those areas of parking not used for vehicular parking, circulation and mechanical. To clarify, a mechanical room serving the building and an elevator lobby within the parking garage would be included in the rentable area.

Thanks,
David
