Hello-
We are working on a large-scale mixed use renovation containing mixed housing, retail, office spaces, and a restaurant. We will be closing a public street that will be open to the retail spaces and classifying it as a "common pedestrian/retail area" with tables, chairs, and landscaping.
Can this common area count toward our gross square footage as a common space?

No, this kind of unenclosed area cannot be included.

Hello again,
I should clarify. If the space is within the Retail component of the building, it may be considered Ancillary Space.
Ancillary Area may be leased to an Occupant but it must be separate from the Gross Leasable Areas. Please review the Retail Standard for more details.

Thank you for your prompt response.
The "common pedestrian/retail area" is enclosed on two sides, but access onto the street must remain open from the remaining two. Would the addition of a canopy/roof classify this space as common public space? It will obviously not be regulated with any heating, ventilating, and air conditioning systems.

Thank you, David. So there will be no way to count toward our gross unless the common pedestrian street were enclosed on all four sides and beneath a roof?

There is no way for it to be common area allocated to Occupants. The only possibility is Ancillary Space under the Retail Standard.
